Under the current system a business that is operating under any name other than the individual’s name (Sole Trader) or legal name (Company) is required to have a registered business name in each state in which they operate.
Each state has its own registration system and fee structure which is an unnecessary administrative burden if a business operates in more than one state. It has been proposed that each state pass legislation handing the business name register to ASIC who will nationally administer the register. For any businesses in different states with the same name, they may be required to change their name to include a geographical identifier. The new system is proposed to commence in early 2012. Once the new system has commenced any new business name registrations can be applied for through the ABR website.
